Kaleida Health Fails to Win Round in Pension Lawsuit Subpoena Battle

Kaleida Health recently faced a setback in its efforts to prevent subpoenas from being served on Mercer Investment Consulting and Nixon Peabody LLP. Despite an attempt to block the subpoena, the company was unable to prevent it from being served.

The court hearing revealed that any attempts by Kaleida to challenge the subpoenas must be pursued through the Southern District of New York, which poses a challenge for the company as Mercer Investment Consulting is primarily located in New York City. Magistrate Judge Jeremiah J. McCarthy of the US District Court for the Western District of New York made this clear during the hearing.

In regards to the subpoena issued to Nixon Peabody LLP, it remains uncertain which court would handle any attempts to quash it. This ambiguity adds some complexity to Kaleida’s legal proceedings as they navigate their response to the subpoenas being served on these entities. The outcome of these legal proceedings could have significant implications for all parties involved.
